Two federal appeals courts last week issued conflicting rulings on whether Americans can receive insurance subsidies through federal exchanges created under the Affordable Care Act (ACA).  In a 2-1 decision, the U.S. Court of Appeals for the District of Columbia Circuit said coverage subsidies can’t be awarded through the 36 federally facilitated exchanges and that they can flow only through the state-run marketplaces. Read the Full Article

On July 22, 2014, the U.S. Court of Appeals for the District of Columbia struck down a major part of The Affordable Care Act (ACA) in the matter of Halbig v. Burwell, ruling that tax subsidies may not be issued in states that deferred to the federal government’s Health Insurance Marketplace rather than establishing state-based exchanges.
